The Sahrawi NGO Alliance submits this shadow report to assess the Kingdom of Morocco's compliance with the International Convention on the Elimination of All Forms of Racial Discrimination.
I. Constitutional and Legislative Framework
The Kingdom has achieved tangible constitutional progress pursuant to the 2011 Constitution, which dedicated a chapter to freedoms and fundamental rights, recognized the plurality of national components, established the Amazigh language as an official language, and created the Authority for Parity and Combating All Forms of Discrimination.
However, the Coalition notes the absence of comprehensive national legislation to combat racial discrimination in conformity with Article 2(d) of the Convention, as existing constitutional and criminal provisions remain insufficient.
II. Migrants and Refugees
The Kingdom adopted a National Migration and Asylum Strategy in 2014 and regularized the status of thousands of migrants from sub-Saharan countries, with UNHCR registering 9,702 refugees and 8,400 asylum seekers. The Coalition commends this policy while calling for continued integration without discriminatory restrictions.
III. Southern Provinces
The Kingdom has allocated substantial support to the Southern Provinces since 1975, encompassing infrastructure development, monthly financial assistance of USD 250 to vulnerable families, housing programs, and enhanced access to services. The region demonstrates the highest rates of political participation nationally, with full exercise of civil and political rights without discrimination, while economic, social and cultural rights are being progressively realized.
Moreover, Hassani oral expression is constitutionally recognized as an integral component of Moroccan cultural identity pursuant to Article 5; however, implementation requires additional financial resources and integration into educational curricula.
Key Recommendations :
1. Enact comprehensive legislation to combat racial discrimination in accordance with the Convention
2. Ensure strict enforcement of law against hate speech and racism
3. Guarantee that assistance reaches its intended beneficiaries in the Southern Provinces
4. Substantially increase financial and academic support for Hassani culture
5. Strengthen education on human rights and citizenship
